Welcome to TLCars.ge (the "Site"), an automotive marketplace platform operated by TLCars.ge ("we," "us," or "our"). The Site allows users to check Vehicle Identification Number (VIN) codes for Korean and USA cars, upload cars for sale, upload car parts for sale, and post automotive services. By accessing or using the Site, you ("you" or "User") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site.

These Terms incorporate by reference our Privacy Policy, which explains how we handle your personal information. We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes constitutes acceptance.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. • Responsibility: You are solely responsible for your User Content. By posting, you represent that it is accurate, lawful, and does not infringe on third-party rights (e.g., copyrights, trademarks, or privacy).
• Prohibited Content: You may not post:
  • Illegal, fraudulent, or misleading information.
  • Stolen or counterfeit items.
  • Content that promotes violence, discrimination, or harm.
  • Spam, viruses, or harmful code.
  • Infringing intellectual property.
• VIN Checks: When using the VIN check feature, you agree to use it only for legitimate purposes and not for any illegal activities.
• License Grant: By posting User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute it on the Site to provide our services.
• Removal: We may remove or edit User Content at our discretion if it violates these Terms or for any other reason.

4. Transactions and Payments

• The Site facilitates connections between buyers and sellers but does not guarantee transactions.
• All sales, purchases, or service agreements are between users. We are not a party to them and disclaim liability for disputes, quality, safety, or legality.
• If we process payments (e.g., for premium listings), we use third-party processors. You agree to their terms.
• Fees: We may charge fees for certain features (e.g., featured listings). Fees are non-refundable unless stated otherwise.
• Taxes: You are responsible for any applicable taxes on transactions.

5. User Conduct

You agree not to:

• Use the Site for illegal purposes or in violation of laws.
• Interfere with the Site's operation (e.g., hacking, DDoS attacks).
• Harvest or scrape data without permission.
• Impersonate others or create false accounts.
• Post unsolicited advertisements or spam.
• Engage in harassment or abusive behavior.

We may monitor activity to enforce these Terms.

6. Intellectual Property

VIN checks and other information are for informational purposes only and may not be complete or accurate. Rely on them at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, even if advised of the possibility. Our total liability shall not exceed the amount you paid us in the past 12 months.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the Site, your User Content, or violations of these Terms.

11. Termination

We may terminate or suspend your access to the Site at any time, without notice, for any reason, including violations of these Terms. Upon termination, your right to use the Site ends immediately.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Site shall be resolved through binding arbitration in Tbilisi, Georgia, under the rules of the Georgian International Arbitration Centre. You waive any right to participate in class actions.

14. Miscellaneous

• Severability: If any provision is invalid, the remaining provisions remain in effect.
• Waiver: No waiver of any term is a continuing waiver.
• Entire Agreement: These Terms constitute the entire agreement between you and us.
